In this website the terms “we”, “our” and “us” means Lucky Dollar Pty Ltd (ABN 43 135 804 116) trading as “A Small Indulgence” and “you” and “your” means the user or customer of this website. “Product” includes the plural “Products” and vice versa.
Unless otherwise specified by law these Terms and Conditions govern the use of the Products and the purchase of any Product from us. Please read them carefully. If you do not agree with them then please do not use this website.
Please note that by accessing, browsing or using this website you acknowledge and agree to be bound by these Terms and Conditions.
We reserve the right to amend or update these Terms and Conditions at any time without notice.
You must be at least eighteen (18) years of age to make a purchase from us.
We do not knowingly accept orders from anyone under the age of eighteen (18) years. By purchasing a Product from us you acknowledge that you are more than eighteen (18) years of age.
In the event that we suffer any loss or damage as a result of a transaction with a person under the age of eighteen (18) years of age we reserve the right to seek compensation for such loss or damage from the parent or guardian of the person who made the transaction with us.

Except as required by the law we do not warrant that this website or any information contained on it or any Product sold by us will meet your requirements or be fit for a particular purchase. If you have any

Product Information and Pricing
Prices of Products and delivery fees displayed on the website are current at the time of display, however prices are subject to variation without notice. We endeavour to provide accurate Product descriptions and pricing, however we do not warrant that such information is accurate, complete, reliable, current or free from errors. You acknowledge that the actual Product purchased may vary slightly from the image on our website.
Product Prices and Delivery
The prices displayed for Products include GST if applicable and include postage/delivery charges to capital cities and major metropolitan areas within Australia. We reserve the right to discuss additional shipping charges if delivery is ourside of these areas or the weight of the stock is greater than 1 kilo. We will provide you with an estimated time of delivery for Products, however if delivery does not occur on the estimated date we will not be liable for any loss or damage resulting from late delivery. You acknowledge and agree that late delivery does not constitute a breach by us of our agreement and does not entitle you to cancel a transaction.
If an item is lost in transit we will not dispatch a replacement item. Any replacement items are dispatched at our sole discretion. We do not accept any liability for any loss or damage arising from items lost, stolen or damaged after delivery has taken place.
Purchases
Please ensure that delivery addresses are complete and accurate. Should you enter the wrong address we will not re-send the order to the correct address at our expense. When you place an order with us you have made an offer to purchase the Product you have chosen and when we issue a tax invoice to you we have accepted your offer. Both offer and acceptance are based on these Terms and Conditions. So as to prevent credit card or payment fraud a Tax Invoice will only be issued when payment has been accepted and validated.
Cancellation
We reserve the right to cancel orders at our sole discretion or if our processes identify any attempt at fraud or for any credit card discrepancies at any time. We are not liable for any loss or damage incurred by you arising out of or in connection with the exercise of this right.
Returns, Exchanges, Refunds
If you wish to return or exchange your purchase you may do so within fourteen (14) days of the date of original purchase. Products returned are required to be in the original condition. Upon verification that Products are in their original condition we will arrange either a refund or exchange at your option. All delivery/postage charges are at your expense. You must return defective or damaged Products within fourteen (14) days of receipt by you.
We will refund the original price of the Products by way of credit card refund. If you request a replacement we will dispatch replacement Product (subject to availability) at our cost. Replacement Product will not be dispatched until receipt of the original damaged or defective Product by us. In the event that Products are returned through Australia Post please retain proof of return as it is your responsibility to provide proof of return in the event that Products are not re-delivered to us. Further, Products are to be adequately packaged to ensure that they are not damaged during return transit.

Credit card payment for purchase of Products is processed by National Australia Bank (NAB Transact). We make no warranty as to the security of NAB Transact and we accept no responsibility for events arising from the unauthorised access of the information you provide via NAB Transact.
Indemnity
You agree to indemnify us against any claims, loss or damage we may incur arising as a result of any breach or non-observance of these Terms and Conditions, your use of this website or the placement or transmission of any information on this website by you. Our maximum liability extends (subject to any applicable laws) only to the refund of the cost of Products or the replacement thereof. We will not be responsible for any direct or indirect loss or damage occurring as a result of the purchase or use of the Products by you or any other person.
Applicable Law
These Terms and Conditions are governed by the laws of New South Wales and you agree to submit to the non-exclusive jurisdiction of the Courts of New South Wales.
